After verbally agreeing to a pregnancy by turkey baster, Robert Boardwine and Joyce Bruce had different visions for each other’s level of involvement in the newborn child’s life. Bruce considered Boardwine to be a sperm donor only and that she would be the only sole parent. Their dispute was decided in Virginia appeals court.
In short, the custody dispute revolves around the fact that Boardwine wished to play a key role in the child’s life with frequent visitation. However, Bruce felt that since she and Boardwine did not have sex, that she would be entitled to full custody of the child.
In the end, the Virginia appeals court granted shared custody to Boardwine on the basis that the pregnancy by means of a turkey baster does not constitute reproductive technology.
